Victory in Federal Court under the ADA

Tom Hillis and Shannon P. Wheeler obtained a successful judgment for their client in the USDC for the Northern District of Oklahoma, dismissing a plaintiff’s claim on the merits under the Americans with Disabilities Act (ADA). The Court agreed with Tom and Shannon’s arguments that the plaintiff could not sustain a case for perceived disability discrimination alleging the employer failed to hire him, failed to accommodate him, and misused employment testing. In dismissing the case, the Court gave deference to the employer’s judgment as to the essential job functions. The Court further agreed that the employer complied with the interactive process for reasonable accommodation. Lastly, the Court approved of the employer’s policy requiring a medical exam after the offer of employment but before the commencement of the job duties as consistent with the Equal Employment Opportunity Commission’s (EEOC) guidelines.
